FAQs

What does a conveyancing attorney do?
A conveyancing attorney manages the legal process involved in transferring ownership of immovable property from one party to another. This includes drafting transfer documentation, liaising with banks and the Deeds Office, ensuring compliance with legislation, and overseeing the registration of the property in the buyer’s name. Our firm assists sellers, buyers, estate agents and financial institutions throughout the entire process to ensure that transactions proceed efficiently and legally.
How long does a property transfer usually take?
A standard property transfer in South Africa typically takes 6 to 12 weeks, depending on factors such as bond approvals, municipal clearance certificates, compliance certificates and Deeds Office turnaround times. Delays can occur if documents are outstanding or if conditions in the sale agreement are not fulfilled timeously. We keep clients informed at every stage of the transfer process.
What costs are involved when buying a property?
When purchasing a property, buyers should budget for several costs, including transfer duty (where applicable), conveyancing fees, Deeds Office fees, and charges related to bond registration if finance is involved. Sellers may also incur costs such as estate agent commission, compliance certificates and rates clearance figures. Our firm provides cost estimates and transparent guidance on all expected expenses.
Can an attorney assist with drafting or reviewing an Offer to Purchase?
Yes. An Offer to Purchase is a legally binding contract once signed by both parties. Having an attorney review or draft the agreement can help ensure that important clauses relating to suspensive conditions, occupation, defects, and timelines are properly addressed. This can prevent disputes and costly legal complications later in the transaction.
What happens if a property sale falls through after the agreement is signed?
If suspensive conditions (such as bond approval) are not fulfilled within the agreed timeframe, the agreement may lapse. However, disputes can arise if either party breaches the agreement. In such cases, legal advice is essential to determine the parties’ rights, remedies, and possible claims for damages.
